What is the difference between DLP and latent defect liability?

DLP is a contractual right to require rectification during a specified period. Latent defect liability (Limitation Act 1980) runs for 6 years (simple contract) or 12 years (deed) from breach of contract (usually practical completion). Latent defects discovered after DLP can still be pursued under limitation.

Can the DLP be extended?

DLP can be extended if defects notified near the end of the DLP remain unrectified. Under JCT, the architect/contract administrator can extend the Rectification Period. Under NEC4, the Project Manager issues a Defects Certificate at the end of the Defects Correction Period.
